Hey there!
I have some very important information on CHT. The fact is is that there is evidence that they have committed fraud. a group of us are going to get the police involved in order to go after the leaders of CHT. I have evidence from CRA and a legal report to prove this. These people need to be stopped and only with a network of people will this occur. CRA has publicly stated that they will re-assess all gifting donation schemes, including CHT. You are guaranteed to be re-assessed! I have been re-assessed. The instructions are to put in your objection to the reassessment and it will go to courts to decide the "legality" of the structure. CHT has been responding to all my emails, even though there's probably nothing in it for them anymore. They've given me the instructions to file the objection.
I remember hearing when I invested that there was a $500,000 "defense fund." I wonder what happens when that's depleted. I also wonder how motivated the promoters are when they've made their money (and I doubt they get much investment anymore!)
According to the CRA they have re-assessed $2.5 billion so far (over several years mind you). So I imagine if the investors win the government will move to pass legislation and close the loophole.
I also wouldn't expect a resolution any time soon. If it takes 5 years or more and you lose, the interest could double the repayment.

Anyone considering donating to the Canadian Humanitarian Trust Fund - should run as fast as they can! My family donated to these liars for a number of years and we were assured over and over there would be no problem. If CRA ever came knocking, they would hire top legal experts to handle it for us. NO worries just bring your check book Please!! Well Canada Revenue Agency has now declared them a scam. Apparently less than 3% of donations ever made it to any third world medical programs. The rest were eaten up by the administrators. Needless to say my parents are going through extreme hardship as CRA wants the money yesterday + interest and they are calling pretty much every few days to start collection. We've contacted the CHT and they said pay CRA and you will definitely get it back when they win their test cases currently before they courts. Does anyone believe this?? CRA should also be handling this better. They were the ones to give this organization it's legitimate ' charity designation' and they are revoking this now years later and seeking blood from it's donors. AT the very least donors should be allowed to claim the actual money donated as a charitable contribution.
I can only imagine the grief other donors are going through. One elderly couple who donated had just sold their farm and were using this to shelter some of the tax they were supposed to pay. They now have to take out a loan to get the CRA off there backs and pay interest on the money. It was rumoured that these organizers were trying to change their name and the scheme around a bit and continue running. They also had an RRsp type investment program started. I hope no one was stupid enough to get involved.

Hi All. I didn't follow my instincts... I donated for 2 years to CHT and just got reassesed. I now owe 10,000 dollars. I did this because my grandmother,uncles, aunties and sister all said it was legit and stupidly I believed them. Although lacking formal education in these matters.... If your gut says don't do it,then DON'T! I have contacted CHT and have gotten absolutely no responce. Now I am screwed!!!

Hello All,
Remember that in order to be "legitimate" all the shelter has to do is register with CRA as a tax shelter - they don't have to demonstrate up front that the components of the shelter itself comply with prevailing tax law. In fact, CRA has been reassessing tax shelters with the buy-low, donate high schemes because of the fact that the tax act states that there cannot be an "advantage" to the taxpayer making a donation. It clarifies to say that the tax credit received from a charitable donation is not considered an advantage. To me, this would be because the economic cost (your cash) is greater than the tax savings. Therefore, when you get a tax credit in excess of the cash put up and the increase in the credit is due not to an economic change but to an arbitrary valuation, then the credit is denied by CRA - so every buy-low, donate-high scheme will be challenged (and in my opinion, lose in court).
For the record though, there is no way that CRA loses 99% of its cases. CRA doesn't go to court on a whim...they go because in their opinion, they are correct. I don't mean they're always correct as I've won many appeals in my day.

What blows my mind are individuals who don't know how the tax laws in Canada work and then submit to the pressure the CRA puts on them. I too have been donating to CHT since 2004. One must remember that the CRA relies on ignorance of the law, and fearmongering to get what they "think" you owe. Did you know that the CRA lose 99% of their court cases. They don't want to go to court so they pressure joe average by using scare tactics to pay up. Over 12,000 individuals contributed to CHT, and as I have talked personally to the founder of the program Stephen Rosen, they are not, nor have they abandoned the donor. In fact they are agressivly fighing the incompetance of the CRA.

swan, I also contributed to the 2004 & 2005 CHT program
I was reassessed on the CHT 2004 contribution in January 2008, and paid back all of the tax plus interest. CRA also disallowed the cash donation portion.
I filed a notice of objection against the 2004 reassessment within the 90-days.
Just this weekend I received another letter from the CRA for 2005, saying the donation (cash & in-kind) was totally disallowed. A call to CRA to the tax avoidance person that sent me the letter asking why ... her response was "wait till you get the notice of reassessment" then you can file an objection, you cant do anything right now.
CHT say they are legitimate, but that does not help me, and my guess is CHT is off the hook. Could it be a scam?
Malcom on this thread says they are legitimate. My response to that Malcom is that you must be one of the people selling the program
I must, like all others, sit waiting on the response from the CRA to my notice of objection.
I would like to know swan, if you filed an objection for 2003 & 2004 and if you have heard back from the CRA?

I was involved with this trust in 2003,2004; and have been reassessed by CRA. For 2003 alone I had to pay thousands in arrears interest,plus.

Be careful. CRA has said they don't like these buy-low donate high tax strategies. CRA could challenge the value of the gift and deem the value of the gift to be the amount you paid for the items donated. Don't forget...just because CRA assesses your tax return as filed doesn't mean they approve of the tax scheme. They can (and often do) still come back and reassess taxpayers later.

Has anyone heard of this trust/fund? Apparently when you donate to the trust they - the trust or whomever - purchases medication in your name and donates the meds to countries in need. You then get a credit for the value of the meds.
