reasonable expectation of profit

I have a client that has been reassessed because their was "no business activity" and therefore the related expenses were determined not to have been incurred in the course of earning business income.

Do the rules of Stewart and Walls court cases still apply or has the draft legislation of CRA been enacted ?

Thanks
